A forced marriage is one which is entered into without the full and free consent of either or both parties. Legislation was introduced in November 2008 to help people who are being forced into marriage or have already been forced into marriage. This includes the power to make a protection order to prevent such a marriage taking place; or voiding a marriage which has already taken place.
Often asked...
What can I do to stop a forced marriage taking place?
An application can be lodged for a ‘protection order’. This order contains the directions deemed necessary to prevent the marriage taking place.
Who can apply?
An application can be made by either party or by someone else on behalf of one of the parties, if they are concerned about the marriage being a forced marriage, however the third party would need the leave of the court.
What do I do if the marriage has already taken place?
Once an application is received, the court can either void the marriage, which treats it as though it has never taken place or dissolve it through divorce.
