Probate

When someone dies it’s a difficult time emotionally and there’s a lot to think about and do. We can talk to you about all the necessary steps, from registering the death and arranging the funeral to finding if there is a Will and dealing with the assets in the estate.

By providing you with help at this difficult time, we’ll take away some of the burden of administering an estate, allowing you time for the grieving process.

What do we do?  We’ll advise and assist with;

  • the provisions of the Will or the intestacy rules if there is no Will
  • collating information on the assets and liabilities of the estate
  • arranging valuations where required
  • finalising the income tax position to the date of death
  • redirecting post from an empty property
  • ensuring that the assets of the estate are safeguarded and insured where necessary
  • completing inheritance tax forms for the Inland Revenue and obtaining funds to settle any tax
  • preparing the necessary papers to apply for a grant of representation from the Probate Registry
  • the closure of accounts, transfer or sale of shareholdings, transfer or sale of property.
  • ensuring payments of legacies are made in a timely fashion
  • advising executors of their personal responsibilities in administering an estate and how best to protect themselves
  • dealing with any creditors of the estate
  • accounting to the beneficiaries of the estate and providing necessary information for their own income tax and capital gains tax positions
  • possible deeds of variation to maximise the tax efficiency for both the estate and the beneficiaries receiving the estate.
  • claims made against an estate by a disgruntled or estranged party.

If you're looking for the Will of someone who has died and want us to check our Will store, please complete and submit the enquiry form.
